On Tuesday, the Ministry of Finance published, on the website of the Center for Governmental Legislation, a bill amending the Law on Upbringing in Sobriety and Combating Alcoholism, the Public Health Law and some other laws. Among the issues covered by the project, There are provisions regarding the wholesale trade permit fee, which entrepreneurs sell alcohol in packages with a capacity of less than 300ml – That is, the so-called monkeys – they must endure.
As stated in the explanatory note to the project, Permit fees for wholesale trade in alcoholic beverages and permit to sell alcoholic beverages stocks for the supply of alcoholic beverages in unit packages with a nominal quantity of the drink not exceeding 300 ml,It was introduced into Polish law by the law amending certain laws related to the promotion of pro-health consumer choices and has been in effect since January 1, 2021.
“The application of the provisions of the law in practice by the National Revenue Administration and the subject of requests for interpretation of provisions submitted by entrepreneurs allowed the identification of issues that raise questions of interpretation and require clarification of provisions by an amendment to the Law of Upbringing in Sobriety, within the scope presented below”- provided for in the justification of the project.
Changes in fees
Changes to be introduced by the amendment include, inter alia, the following: Regulating the rules for paying this fee without changing its value, which is 25 PLN for every full liter at 100%. Alcohol in alcoholic beverages. The new regulations also emphasize the one-time fee principle. Therefore, if a fee for alcoholic beverages has already been paid – for example, by a wholesaler – the retailer does not have such an obligation.
The “phrase from which the fee was paid” is inaccurate and may be misleading due to the fact that the fee is paid only twice a year – for the first half of the year until the end of July and for the second half of the year until the end of January. Before these deadlines, these deadlines were not met provided that the fee is paid. Therefore, a businessman who has continued to supply alcoholic beverages cannot be exempted from the obligation to pay the fee, which was not the intention of the legislator ”- indicated in the justification.
The amendment, according to the project, is scheduled to enter into force on July 1, 2023.
