The agenda of the Enea Extraordinary General Assembly scheduled for January 30, 2024 includes a draft resolution on approving the company to pursue claims for compensation for damages caused in the exercise of management or supervision against the members of the then Management Board and Supervisory Board.
In 2018-2019, members of the then Management Board and Supervisory Board made decisions on behalf of the company regarding Enea's investment in the Ostrołęka C power unit.

The company indicates that following up on claims is an implementation of the recommendation of the Financial Supervision Bureau contained in the subsequent statement of the Financial Supervision Bureau issued on June 29, 2021.
The draft resolution of the Enea Extraordinary General Assembly also includes the subsequent approval of the company to file a lawsuit on December 28, 2023 against the members of the then management board and supervisory board of the company, as well as against the insurance company.
As part of the lawsuit, Enea is seeking claims for a total amount of PLN 656.2 million.
