The President’s Chancellery announced Thursday that the President has signed into law the Packaging Deposit Refund Scheme. The amendment stipulates that the deposit refund system will be implemented in Poland on January 1, 2025.
It is related to the law amending the packaging waste management law and some other laws. The new regulations will implement EU directives on reducing the environmental impact of certain plastic products.
Assumptions of the deposit recovery system
The amendment provides for adding a deposit to disposable plastic bottles with a capacity of up to 3 liters, reusable glass bottles with a capacity of up to 1.5 liters and metal cans with a capacity of up to 1 liter, from which the quantity will be calculated. to be specified in the regulation.
According to the draft regulation published in April, its value is PLN 0.50. The deposit will be returned when the package is returned to the store without the need to show the receipt.
Large stores with an area of more than 200 square meters will have to collect empty packages, while stores with a smaller footprint will be able to join the system voluntarily. Uncollected deposits will be used to fund the deposit recovery scheme.
The deposit recovery system means new obligations for entrepreneurs
The deposit refund system will be set up by entrepreneurs who market packaged beverages. They will appoint an operator (representing entity) responsible for implementing and operating the system. As indicated in the justification, the regulations do not specify the number of such entities, and therefore it is possible to establish two or more deposit recovery schemes. If entrepreneurs serving bottled beverages do not establish a system or fail to achieve the required levels of selective collection of packaging and waste, they will have to pay producer fees.
