— We have discovered critical errors that prevent the introduction of KSeF in 2024. – said the Minister of Finance. — We cannot allow a situation in which Polish companies cannot issue invoices.
Domanski added, The Ministry will publish a tender for external audit of the system. We will intensify the consultation process so that the system is not introduced against our will, but rather in cooperation with entrepreneurs.
In response to journalists' questions, Domansky confirmed this The new date will only be announced based on the results of the audit. However, the government stresses that it is not abandoning the system.
– KSeF will be introduced in Poland. This is a necessary solution, as it will make the system more compact and, in the long run, make running the business easier. but We cannot afford even one day where invoices cannot be issued. There is no room for any flaws – said Domanski in response to questions from Business Insider Polska.
An exciting decision for the Ministry
Friday's decision came as a big surprise. The Ministry of Finance – led by Minister Domanski – has repeatedly denied that the date of entry into force of the mandatory KSeF law is in jeopardy.
At the end of 2023, the Ministry of Finance, in response to questions from Business Insider, admitted that there was no plan to postpone the deadline again.
The new Deputy Minister of Finance, Jaroslav Ninman, also emphasized that the introduction of mandatory KSeF is the Ministry of Finance's priority.
What is KSeF?
The National Electronic Invoice System is, quite simply, an IT system where entrepreneurs issue all their invoices. But not only. He is a servant For complete handling of organized invoices: issuance, access, receipt and storage.
Without KSeF, you will not be able to function normally, or at least continue accounting in your company. The system verifies, among other things: the correctness of the logical structure of the issued electronic invoice and the correctness of its data, as well as the rights of the person who enters the electronic invoice into the system.
Until now, the invoice issuance date has been determined by the taxpayer independently – this will be done automatically in the KSeF. Pursuant to art. 106 In Section 1 of the VAT Act, a regulated invoice is deemed to have been issued on the day it is sent to the KSeF. Turn art. Article 106na 3 of the VAT Act indicates that a structured invoice is deemed to have been received using the national electronic invoice system on the day it is assigned an identification number in that system.
A revolution for entrepreneurs
Therefore, KSeF is a real revolution for entrepreneurs. Because even though the system already works, it is still voluntary and anyone interested can join. However, from July 2024, this was due to change and all entrepreneurs must be connected to the system.
This is a problem because the vast majority of entities are not using it yet, and many have not even begun preparations for it. We could face major paralysis in the second half.
We regularly inform Business Insider about issues that may arise in relation to KSeF. Concerns include: Whether invoice data sent to KSeF is secure. In response to Business Insider's questions, the Ministry of Finance confirmed that there is no reason to be afraid, because the Ministry is prepared to receive up to 100 million invoices per day to pass through the KSeF system as of July 1, 2024.

Some organizations and experts (including Liviatan, Ombudsman for Small and Medium-Sized Enterprise Owners) have claimed that the entry into force of the KSeF should be postponed until January 1, 2025.
However, there is no consensus among experts. Some tax professionals believe another deferral will be necessary (The Ministry of Finance has already postponed the deadline once – from January 1, 2024 to July 1, 2024.) You won't do anything.
