The drama of Ms. Patricia and Mr. Krzysztof from Bydgoszcz (Kuyavian-Pomeranian Voivodeship) began in August, when they paid an advance payment of PLN 30,000 for heating with a heat pump. The Kwidzyn company did not have time to fulfill the contract, which was supposed to be completed by the end of December, and in November filed an application with the court to initiate bankruptcy proceedings – as the journalists of “Interwencja” described.
However, the court found that the company did not have the funds to cover the costs of the proceedings and the company was liquidated. — As a rule, in such a situation, a member of the board of directors is liable for the company’s obligations. Unless, in a possible lawsuit against him, he proves that the bankruptcy application was filed on time — as Lukasz Ziola from the District Court in Gdańsk described in an interview with Polsat reporters.
He considered that the appropriate period does not exceed 30 days from the date of the reasons for declaring bankruptcy. He added that the Commercial Court Gazette announced on July 10 the opening of the company’s liquidation, and called on all creditors to submit their claims to the company within three months.
The Attorney General’s Office has discontinued the cases against the company’s clients. However, the investigation is still ongoing.
